It is a derivative work, but if it's sufficiently different that nobody could prove it, only this very chat log could result in an action against you.

Copyright is the main thing to be worried about here, actually. Higher damages, easier for SO to attack without a court case thanks to the DMCA, easier to prove, and statutory damages available.

You don't want them to be patentable, but the courts say they are, so they are until congress writes a new patent law saying otherwise.

It's only subjective in the sense that the patent office doesn't enforce it, they let the courts enforce it
 
It's not like when those patents get to court they're thrown out, they're upheld just as often

You can't simply dismiss the patent system by saying it's bogus. It's there and if you want it gone someone must make it go.
