It belongs to the guy who wrote Code Complete, or Rapid Development, one or the other (or both).
Like I said, Jeff got special permission to use that avatar, but user avatars are CC on Stack Overflow.

I think what matters is trademark and SE site policy, but I would be very surprised if any two different users could not have the same avatar.

@Cupcake: that is probably about the naming choice and the mood of the picture rather than the trademark of it.
I do not see any legal statement there.
The image is used in a book. That's where it originally came from. If it weren't for SO's CC, I would say that it's a copyright violation to use it without promotion.

Though the user probably doesn't have permission to use the image.
@Cupcake But when I saw that picture in a thread I was in, I assumed, like most other regulars would, that that was Jeff Atwood... I just happened to look at the name like a second later and realized it wasn't. So at the very least it's deceptive.
Oh, by the way, SO doesn't enforce copyright unless issued a DMCA.

@Cupcake FYI, IRC does rate-limiting, too. Even worse, it disconnects you from the server if you fill up the message buffer (usually 1kb) completely.
