It's not "you promise you will buy a new identical one," they just offered that she could beg the same people who maliciously broke her original diamond to maybe consider giving her a new one. With no evidence that said consideration will be any more fair than what caused the original situation. — Kevin 1 min ago
This post is blowing up

try not to throw any more fuel on if you don't have to
that is not to say you should self censor, just a consideration

we really don't need twenty links to that post in the transcript
We all read meta.

Ok, so it's not all rainbows & unicorns. But it's a big step in the right direction. I just wish people could be responding a little more positively, rather than reinforcing Sara's view that MSE is a toxic hellhole. :(

@PM2Ring it is all legal stuff if you ask me.

@rene Sure. But it's a favorable outcome. If it went to court, it could've dragged on for ages, cost Monica more money than she could raise or afford, and there was definitely no certainty that she'd win. So I'm reasonably ok with this. However, SI Inc should give her back her diamonds, no strings attached. And they really should make some prominent public announcements (off the SE network) to counteract the negative stuff that happened on The Register.

7:15 PM
yeah, reinstatement is still a thing.

The only thing Monica wouldn't be able to pay off the court is because SE is actively and successfully censoring every link to the fund

In an ideal world they'd give her her diamonds back, follow up with a second, more personal apology and discuss changes in management and process with specifics and firm commitments to avoid a repeat
And I mean give back as in "We messed up, and we'll be correcting that by actually undoing our messed up action. No process since the removal was out of process also"

> No further donations are needed. Thank you everybody for your support!

To me it reads "I've had enough threats from SE. I can't go on, and I'm not even allowed to say it's a loss for me"

meh
there's not enough information to really say it's x or y
and agreement was reached, and now we move forward

7:22 PM
@JohnDvorak In their defense, they've clearly not been doing that. Only a few links have been removed. They haven't been actively searching for them.

This mess was started by not following due process in removal. They're not now going to bypass the process for reinstatement at this point.

Well, considering the the "process" is quite literally asking the same people to look at the same data and come to a different conclusion, calling it a process might be a bit too generous.

but that process presumes that process was followed to cause the situation it seeks to remedy, which it was in this case not.

I don't blame Monica for not wanting to legitimize that by submitting to it.

Well... not necessarily the same people.
But yeah.

7:24 PM
the new process does read like a star chamber

@terdon-stopharmingMonica Schrödinger process?

no protection against railroading et al, but that was pointed out by 80+ answers in the feedback post and nothing was changed on the process front

Also that. The process per se has .. many flaws.

Is StackOverflow sabotaging itself?

@rene Einstein. He's the one who defined madness as doing the same thing and expecting different results.

7:25 PM
Ha!

@Tinkeringbell hi, the comments on that new post are getting really bad, attacking Sara as a scapegoat—might want to delete some? Thanks

@terdon-stopharmingMonica Submitting to the reinstatement process and then failing it would undo some of the benefit of the public statement. It would essentially be a backdoor to SE implying "still a bigot" by not allowing the reinstatement

What is wrong with a post that indicates the company is attempting to fix things? People who downvote this clearly don’t want to ever have a solution. — Stormblessed 1 min ago

@Stormblessed *cough* <insert Null message here> *cough*

she is sendinger her diamond to dev/null

7:27 PM
The reinstatement process makes sense for mods who chose to step down. But if you've had your diamond removed by "employees" and then will have these same, unspecified employees look at the very same data they had originally when they decided to demod you, I don't see why anyone would bother.

@Mithical huh? I’m confused sorry

@MadScientist that too

@Stormblessed it's a statement by their lawyers. I'm not that cynical (yet) but you could credibly see this as them being dragged by their lawyers to post it.

@Ṁűỻịgǻṇạcểơửṩᛗ What’s dev/null?

@Stormblessed Is there something wrong with your flag button?

7:28 PM
Oh sorry mobile is glitchy :-/

I understand either reaction to this tbh

Disagreed. If you stepped down voluntarily, you should be able to rejoin at any time without approval, IMO

For Monica to submit to the reinstatement process is basically admitting that the removal of her diamonds in the 1st place was legitimate. But I suppose the mod agreement does say that SE reserves the right to de-mod someone if they believe it's necessary. OTOH, if she did apply for reinstatement, I can't imagine any sane person blocking the reinstatement.

As is current mods can hard veto any reinstatement
that has been used 3 times already iirc

@JohnDvorak Well, yes and no. I don't object to having to go through a process. If only to check that I did indeed choose to step down and I wasn't hiding some horrible thing.
But essentially, if the mod stepped down in good standing, the reinstatement process is just rubber stamping their return.

7:29 PM
@Stormblessed To oblivion

@Stormblessed Gimme a sec :)

@PM2Ring well, we're dealing with mods here ...

:D

It's for cases where a mod has been kicked with no explanation that it just doesn't make sense and doesn't actually provide the mod with a way of defending themselves.

mods should never be kicked with no explaination

7:29 PM
@Magisch huh? It has?

@terdon-stopharmingMonica it's far too convoluted to serve as a rubber stamp. The mod signing a form would be a rubber stamp.

they should provide one

@Magisch Well no, of course not. But Monica was.

right, but lets hope this whole drama has put the fear of {insert deity} into SE to not try that again

In any case, I do not believe that unilaterally reinstating Monica is a good idea. Given the context leading up to the dismissal, I do not think it unreasonable to require her to go through the process.

7:31 PM
@JohnDvorak I don't object to asking the remaining mods if they're OK with a return. Nor with SE checking that there is no reason to think the return would be a bad idea (e.g. because the mod has behaving in certain ways since being demodded). I actually want there to be some sort of process. I am not comfortable with the idea that I can always get my two diamonds back whenever I like just by saying so.

Sara doesn't seem to have a good hand to communicate with the community. But it's probably the fault of the one(s) who instantiated her in the position she holds at SO Inc.

@Mithical i'd agree if the process was transparent and impartial

They should at least have a look at my recent activity to ensure I haven't grown any horns or a tail recently.

Okay. How about Monica reapplying, but then SOF unconditionally give her the diamond?
Monica can chose not to even apply.

if you were monica, would you have the faintest speck of trust left that this isn't just a vehicle to rubberstamp management decisions?

7:32 PM
It may be reasonable to ask Monica to go through a process. It's not reasonable to ask her to go through the one in place.

@Mithical Agreed. And even reinstating her might just never be an option: would she become just another mod or will she always be that mod? Would she even want to come back? I know I no longer felt comfortable being a mod on multiple sites backed by this company. But if she were to come back, there should indeed be a process.

@Magisch Effectively nil. The best I could hope for is to act in such a way to build awareness.

But it can't be a process that's just the same people looking at the same data. That's just a joke.

I've said it before. Independant arbitration for the process

@terdon-stopharmingMonica Yeah. She's never going to be able to be just another user on SE ever again.

7:34 PM
SE management has forfeited their credibility of being in charge of the process

@Ṁűỻịgǻṇạcểơửṩᛗ I'd feel more comfortable if you could avoid needless exaggeration like "obliterated" or naming specific employees. That way lies drama.
3

@Ṁűỻịgǻṇạcểơửṩᛗ no discussing or speculating on individual employees in this room

it's unfair and we don't know anything about the inner workings of SE. This is a bright line.

In the process of determining their legal position, SE almost certainly went over all the information that would also be used in reinstatement. The outcome is almost certainly known to SE already, so it seems unreasonably to pretend otherwise

It's kinda silly to me to think the company shouldn't have the ability to decide to demod someone for whatever reason they deem reasonable.

@MadScientist Legal has absolutely nothing to do with reinstatement. The mod agreement even states explicitly that SE can terminate the moderatorship whenever they want for whatever reason with no warning. Legal has to do with the defamation that happened afterwards.

7:38 PM
Compare this to an at will employment

So... reinstatement and defamation are two separate issues.
This addressed the defamation. Reinstatement is out of legal's hands.

The core issue isn't that a well-standing moderator was stripped of a diamond without as much as an explanation. The core issue is how that was done. And that's putting it extremely lightly.

@Mithical still, several people have been closely over every inch of her file by now
without even applying for it, she probably got the most scrutiny that any moderator will ever see already.

@Mithical Well, it was a start, yes. I'd love to see that statement a bit more publicly though. But it's a start.

It's a start. Even though there are still very serious gaps. The best way is to wait out. And let the final verdict come through, whoever moves first.

7:44 PM
For my purposes, SE has stated that they will never be speaking to the press etc about people ever again, which is a something necessary. They have stated that they were in the wrong to do that in the first place. It's featured across the network in at attempt to get as many people as possible to see it. That case is closed, at least for me. That's fine. My main issue now is how SE intends to protect the safety of its users and moderators internally.

I'm afraid waiting out is exactly what the company is trying to do

So SE is attempting to initially defame Monica, and then state that all of that drama is false.

I do agree that "Let's not badmouth anyone in the press anymore" is a step forward

@MulliganReinstatingMonica *confused squinting*

Also, please do not call out or attack specific people anymore.

7:46 PM
@JohnDvorak That one they did own up to quickly and unambiguously though.
That isn't new.

A: Under what circumstances will Stack Exchange, Inc. share private/sensitive information with the press?

Shog9We didn't have a policy here; we do now: "no comment." This is the first time that we've been asked to comment on a quote concerning a moderator, and reporters aren't always very forthcoming. So we've codified "no comment" as a policy and will operate using it going forward. Moderators are free...

I know

I mean, the situation was really damn cruel
not owning up to that would have put them in the same camp as online harassers

Well yes. And it has.

and open to ligit... litig... you know what I mean

while it is definitely a welcome step in the right direction, it's more on the order of "we won't throw any more puppies into the live incinerator" to me
I never could have dreamed they'd do something like this

7:48 PM
That's... a rather... vivid metaphor.

Rob
The backseat driver and armchair quarterback had a baby, and have a ticket to ride:

yeah, it captures my feelings on the press comments fairly well
I associate that kind of tactic with 4 chan boards, not a company I held in high moral regard

@Mithical Not really. Only the incinerator was live, not the puppies. ;)

Indeed. Furthermore, the incinerator was live, yet not living.

Rob

7:49 PM
but I'm certainly an extremist when it comes to online privacy
someone doing something like this to me is a thing I have nightmares about

Quite. And seeing the one company you used to think was actually halfway decent and ethical and composed of people who get it do it is doubly terrifying.

Get it do that halfway decent and ethical, or utterly diamond destroying

The diamond really is the least of it. We all know and accept that SE can remove our diamonds at any time. That's part of the moderator agreement.
had they just removed her diamonds, we would have been over it by now.

i doubt it

8:00 PM
Everyone can dispute a diamond removal. Her diamond removal is unanimously unfair.

"Her diamond removal is unanimously unfair." - not necessarily.

unless you have TL transcripts, it looks that way

It isn't, actually. Not unanimously. There are quite a few people who either don't care or actively agree with the removal.

not that SE has done anything to combat this perception

Most of those, however, certainly disagree with the way it was handled.

In any case, I do not believe that unilaterally reinstating Monica is a good idea. Given the context leading up to the dismissal, I do not think it unreasonable to require her to go through the process.

Especially the way the aftermath was handled...

Is the aftermath even handled? Are we just at square one
I am seriously losing the will to discuss with this thing.

@MulliganReinstatingMonica Depends on what you count as aftermath ;) I was mostly referring to talking to the press about this, and how rumours were allowed to spread on MSE about all this.

I didn't just see the context, I was actively involved. Saying that the dismissal was unfair or that it was without warning is simply inaccurate. It was grossly mishandled and done in a completely inappropriate way, which led to a slew of other issues, but the initial dismissal, in isolation, was not the biggest deal.

My fault a bit too, I rage-quit for a few days :)

8:04 PM
I am unfortunately one of those who ain't actively involved. I simply do not have the time to contribute to SOF since I need to prioritize my work and intensively study new programming and research.\
Good thing is I am not going to rage quit though I am deeply upset.

@Magisch It is a bit of an issue that all the initial context was private; that's been causing problems from the very beginning.
Sep 28 at 20:21, by Mithrandir
There's a lot of complicated and nuanced stuff happening, mostly in private at the moment. Public speculation and discussion is really not going to be helpful at the moment; please respect that.

@Mithical Without warning isn't inaccurate.

@terdon-stopharmingMonica Well... that depends on how you define a "warning".

Warning could be any notice or some unfavorable response.
IT could even be nonverbal like how often or willing you want to message.

Well, a warning would be "If you do X, your diamond will be removed". There was no such thing.

8:07 PM
There is something as in "official warning" or "written warning" or "final warning"

In fact, there was nothing I could perceive as any sort of warning at all. The closest thing was a staff member implying that maybe this isn't the place for her.
7

She wasn't told that she was risking dismissal, which was bad. But she had been told... months before the CoC update that her actions and words were harming people.

Guys...

@Mithical That is not a warning. It is relevant, yes, but not a warning.

Perhaps not gossip this much?

8:08 PM
No gossip. Be quiet.

This is not gossip

Or elsewhere?

Why? This is a post on MSE. Where else should we talk about it?

It's pointless anyway. That's all been done and cannot be changed.

It's not worthy to add gasoline to the flames which burned down the house

gossip: casual or unconstrained conversation or reports about other people, typically involving details which are not confirmed as true.

Seems about right to me.

in my mind gossip is fair game

@Andy Mith and I were rehashing the old stuff again, not the new post.

as long as you don't mention SE employees by name

And I really doubt either of us has anything to add which we haven't said 100 times before. Neither @Mithical nor I have been particularly silent over this ;)

A: Update: an agreement with Monica Cellio

VikingoS says Reinstate MonicaYou might have an agreement with Monica. But you certainly did not calm the community. The fact that the agreement contains the publication of this statement is quite revealing, as it is patronizing and puts the blame and guilt on Monica again. You must have put a lot of pressure on her to sign ...

Yah. That user is still attacking.

@Tinkeringbell Yeah, that's not how this works. We were here and have opinions. We were in TL and have opinions on that too. "Confirmed as true" - to make sure I'm understanding you, are you saying that anything not posted out of TL is "unconfirmed"?

@Andy You can talk about the new post. What I'd like to avoid is talking about Monica and have a casual, unconstrained conversation about her with details that aren't confirmed as true ;)

Oh hey, @Mithical I've been wanting to tell you how much I appreciated the comment you left on my resignation post on AU. As the chattiest denizen of the TL, a place I know you have felt uncomfortable in, I had sort of assumed I must have been part of the problem and I was very touched by your kind words.
So thank you!

8:11 PM
@Andy I'm saying this is a public room and I've lost track of what was leaked or not and that we'd be better people if we just not leaked anything out of it at all?

:)

does it really matter at this point

Because it's going to be a massive pain in the ass to 'confirm things as true'.

Please. As I said. Let's be quiet.

@djsmiley2k-CoW What's that wavelenght? I could use some of it right now :)
@MulliganReinstatingMonica Misinterpreting my words doesn't help the situation either. Don't.

8:12 PM
You know what, it's not worth my time to do this. I disagree with you, but not enough to argue. Have a good holiday season.

@Tinkeringbell may cause cancer in the state of california ;)

@Andy You too!

I am already losing productivity.

@djsmiley2k-CoW Hmm. I'm in the Netherlands though ;)

8:13 PM
@Magisch Yeah... this involves context and people that dates back way before anything blew up, which I can't access anymore and can't confirm, and which has not been leaked or made public to the extent that other topics have. I will leave it at what I was leading up to: Demanding unilateral reinstatement is not an actionable goal and should not be something the community is demanding, especially lacking prior context.

@Mithical can you honestly ask that we non mods not demand it
we don't have your context, and where should we find the confidence to believe all this on faith?

How about this. Is it better for us to be quiet from now on, and let Monica and the SOF staff deal with this alone?

@Magisch Ask? Yeah. Demand or expect to be listened to? Nah.

Ask? Perhaps. Demand? Absolutely not. Suggest that it's just pointless so you may as well not ask and instead focus on things that are attainable? I would say yes, absolutely.
Ah, ninja'd!

@Tinkeringbell I'll see if I can get a nice few

@terdon-stopharmingMonica Aaaaa

I quite like having them in here, they're funny at least.
Just kinda sad as the kids haven't bonded with them, as we got them too young (the guinea's, not the kids! :D )

We had one too (was my oldest brother's pet). I liked him, scuffling around his cage in the evening. The room seemed very quiet for a while after he died.

not sure how they got the dog like that but it's funny to see a giant scary dog that is such a softie

his hair is longer
I'm guessing he's a mix, his mum was short haired, we've no idea who the dad was.

@djsmiley2k-CoW You need to vacuum :P

8:23 PM
sounds like work

I want to cuddle all of them

@Mithical That makes sense, she should have to go through a process, but not the reinstatement process, as that contains a presumption of guilt. Rather, she should go through the conduct removal process, and if the outcome of that is to not remove her, then she should be reinstated.

@SonictheReinstateMonica-hog I think the issue there maybe "we know she'll jhust break the now implemented rules."
While, I agree with you - I can see why the company doesn't want to do that.

All cats are cuddly.
But wait, no:

A bit too late, but can we not incite YouTube logic here please? Peer pressure like this can only make the whole thing even more toxic and depressing.
So.
Can someone give me an update?
@Mithical Darth Vader sucks. There I said it. I want him impeached.
A brief-ish glance tells me two things: 1) -100-something is because of the conditional-ness of the reinstatement, so it's underwhelming, and 2) There may have probably potentially maybe mayhap been an agreement.
Obviously the latter can't be reasonably discussed here, but the first one ironically seems like an underwhelming reason for the backlash against the underwhelming update.
Maybe people just don't like the lawyerese but I'm thinking there's quite a bit I'm missing.
The post score is -120 now. Are there other reasons it's still disapproval from the significant majority?

@M.A.R. I think you actually hit it quite spot on... The post is written in a way that people can easily dismiss it as 'not good enough'.

We guess the royal "we" makes it too easy

As with a lot of Sara's recent SE contributions, to me, the post reads like a huge disconnect between SE and the community.

But . . . seriously, just that?

9:56 PM
It's dehumanized

It reads like it was written by a professional, and people don't like that, they'll likely dismiss it as 'not actually contrite'.

To the point of it being insulting

Well that's not new

We don't need new reasons to dislike something though

I'd not worry about it too much, or read too much into it. The good part is that there's an undefined agreement made.

9:57 PM
OK maybe I can crawl back to my hole
@Cerbrus Just if it's a wall of text I guess.

@M.A.R. You're always welcome here but yeah... If you don't want to see all the anger, a hole is a good hide out :)

I guess the previous nonapology apologies make it a bit hard to trust 'em too.
@Tinkeringbell Well Tavern's got more frustration than anger, oftentimes

@M.A.R. Yea, it's just a bunch of words they lawyers told them to write
Or at least, that's what it looks like

An apology that's demanded is never going to carry the weight or tone of one that's freely given, I guess.

True, but as with previous posts, this could've been so much better

9:59 PM
@Cerbrus Maybe that I'm not too angry at it is because I never thought they'd admit to this much.

Oh I'm not angry
I'm getting rather tired of seeing Monica's name and that "reinstate monica"banner all over SE, and I've had enough of that whole discussion

A whole lotta fire is still left but some water was sprinkled. Now if they don't add more like it happens every week after some related or unrelated 'incident' is another matter
@Cerbrus Lol. Now I wanna see you say that line in a movie
With a samurai blade on one hand and a double barrel shotgun on another

With a Samuel L. Jackson-style MotherF**** ?
Or a Gerald-style "F***"?

@Cerbrus I can totally imagine the voice coming out of the smiley wolf's mouth in your avatar

@Cerbrus That one. But no spoilers!

10:02 PM
Haha
@Tinkeringbell I watched the whole season in 1 day...
F***.
Now I have to wait again

@Cerbrus People keep interrupting me. For silly things like dinner, darts, or concerts ;)

You will know my name is the Lord when I lay my close vote upon thee.

@Tinkeringbell Lock the doors and close the blinds, you're going for a ride

. . . which is why people have been arguing for close voter names to be hidden

@Cerbrus I'll manage to finish watching it before Christmas, I hope :)

10:05 PM
Quoters assemble!

Actually, the lyrics of "I can't decide" are pretty fitting for Gerald
"It's a b**ch convincing people to like you"
I'm not a gangster tonight
Don't wanna be a bad guy
I'm just a loner baby
And now you've gotten in my way
Yup, Butcher of Blaviken ^

It's now at -126. What's the up & down vote breakdown on it?

+77 -203

Thanks
I guess that's a repcap, then.

Oof, on closer inspection, quite a few folks are being too emotional. Hole it is.

10:11 PM
@PM2Ring Please don't go there?
It almost never ends well. And some people may just be genuinely relieved an agreement was reached.

FTR @Tink Tavern is part of my hole, it's just that the exams are coming and I don't have much time to spare

@Tinkeringbell I wasn't going anywhere, but please feel free to bin any of my posts that you think may have a deleterious effect.

@Tinkeringbell It never went well. The posts which enumerated the events inevitably got a huge upvote count. I am also one of the users who sent an edit to update these events.

I'm genuinely relieved that an agreement has been reached. And happy to say I gave Sara's post an upvote. I'm not happy with the degree of negative response it's received.

Are they the most negatively received posts of all of SE

10:16 PM
@PM2Ring 👍
@MulliganReinstatingMonica Yes, yes they are

We are witnessing history

In terms of vote count and score
This is historically significant

In boldface even

@M.A.R. Aww. Sorry the hole is a bit of a mess at the bottom again ;)
@PM2Ring Ah. Might be a bit too much on my toes... I've seen people complain about rep caps being undeserved and such. Just saying the negative response is disappointing is something I can live with though :)

10:19 PM
If the core MSE crowd don't want SO Inc to basically abandon MSE as too toxic for rational communication, they're currently not doing a very good job...

Is there anything redeeming about her "a p o l o g y" ???
Do you think we are being too loud

@PM2Ring True. But it's hard to tell people that, let alone change their minds. I guess at this point, the best to do is be the best example of how stuff should work...

Maybe that the non-moderators don't want to get too much into moderator stuff, because it doesn't apply to them until they become diamonds

@Tinkeringbell Looks around the room well my room does give "mess" a whole new meaning
The saying goes in Turkish "A grenade has gone off here". Well, grenades can't do this

@M.A.R. Yours should meet mine then! The offspring will be something Lovecraftian ;)
@M.A.R. Ah yeah there's a similar one in Dutch: a bomb exploded in here

10:23 PM
A bomb spew huge amounts of dung here\

My room is so messy it annihilates with matter.

@M.A.R. Ahh. Mine is currently covered in half read books, unfinished crochet projects, balls of scrap yarn... And empty boxes..

@MulliganReinstatingMonica Considering some of the alternatives, yes. Eg, Monica spending over $100,000 on a lawsuit that dragged on, and which she lost.

That's leaving out the boxes of stuff that I need once I get an apartment of my own ;)

Books, medication, old, torn books, random papers, receipts, and a pair of saddles

10:25 PM
I'm going to sign the paperwork tomorrow! If everything goes well, they'll start building in January

And that's just what's on the floor

If you were here it would have been

My floor is covered mostly in shoes, slippers, clothes, and some of those empty boxes

But I don't think I have fully discovered some locations in my room yet

10:27 PM
There are definitely some I haven't seen for years

Ok, so this is not trolling, but as a long time SO contributor I'm curious, can someone give me a tldr of the whole episode with Monica?
(Check my profile if you like, been around since 2012, 50K rep. I've just dropped off the face of the site for a few years.)

@Moshe She got demodded, SE talked to the press about that, she started a GoFundMe for a lawsuit, and now they've reached an agreement about that part, it seems.

@Moshe meta.stackexchange.com/questions/333965/… This links to most of it

That was what I was missing. Ok, thanks for the tldr

10:52 PM
@PM2Ring well - unfortunately there's also a crowd that feels applying any sort of pressure possible is good. And a second crowd just here for the drama

👍

Looks like I have some catching up to do

Yeah, the fire is still burning. Can you take over damage control while I go to sleep? :)

I wonder how differently this same exact statement would have been received if it was issued before the end of October rather than today.

probably much better even if still poor

10:59 PM
@JasonAller Probably? Not much differently, given how people accused the posts that were made rather quickly of being 'too empty' too.
