@enderland You want a list? I'll provide one... Be warned: each entry is described in the most passive-aggressive manner possible. In fact, it's not so much a list as it is a long rambling story with many asides and back-handed compliments.
@Mgetz it's 6 degrees here. But, the snow appears to have stopped falling for the moment.

@Shog9 so just like one of your posts?🤣

12:18 AM
@Shog9 :-)
you betcha!

uf

12:59 AM
@Shog9 da?

ya, sure

:-)

it's a good place to be

Indeed

so many other places, you just can't get good lefse

1:24 AM
......
@Shog9 I have a recipie for it on my fridge
my mom's been promising to try to make it for over a year
;p

big flat fry pan that you can heat evenly is key

Ah
We have our pancake griddles.

also, mix the hot riced potatoes w/ the flour really well before adding wet

A lefke is basically a potato chappati

me, I really don't care to bite into a chunk of potato

1:27 AM
@Shog9 my mom typically takes a lot of convincing before trying anything new if it wasn't her idea ;p

growing up, lefse was the aunts' job. My sisters took over later. I guess my mom picked it up at some point, but not while I was home

4 hours later…
5:03 AM
I have been summoned!
Indeed my name starts with a lowercase letter.

@WebHead - I suppose one could submit a query, in the same way that the assisted living facility did. I'm not sure how quickly they would respond. If I were a moderator, I'd be forming an independent moderator organization, and try to reach consensus to file a complaint with the state of NY. Also, I'd be looking for some consensus list of goals for a mediated settlement agreement, that would lay out a different structure, so that volunteer moderators have more job security, and more collective control over policies and procedures. I haven't figured out what to do about the payment aspect. — aparente001 13 mins ago

user310756
Anyone interested in pursuing this?

A: Is StackExchange in violation of New York labor law, in using volunteer moderators?

aparente001The answer would appear to be yes, it's in violation, according to the logic the state has published. I found a five-page 2009 guidance letter about volunteers and interns, which shows how individual situations should be analyzed, in some detail. The specific situation that the guidance lette...

5:52 AM
sigh
Goes a little far does it not?

Rob
Suddenly everyone's a lawyer :)

Rob
And an accomplice, because by posting they agreed to the ToS.

So here's a critical question here.
What are we actually trying to do

Rob
I'm about to make a coffee.

user310756
@JourneymanGeek how so?

5:57 AM
Now, I'm all for getting Monica an apology

user310756
there's a gofundme being supported on the site to raise money for litigation against the company

But this looks pretty much like "Lets just burn all the bridges

user310756
well it's not

That's different. Hurt was done to an individual. Hopefully that hurt is fixed, and we can work on preventing things like this happening

Rob
More like build first, then burn.

5:58 AM
If SE is in violation of New York labour law...
no. more. mods

user310756
@Rob ?

Rob
There was no defamation; so if the litigation does move forward... that's a good waste of $10,000 and time

user310756
@Rob a waste of raised money you mean?

Probably some lawyer getting a few mods or ex mods together in a class action suit and making a mint
then... what?

Rob
How do?

user310756
5:59 AM
it doesn't necessarily require a lawyer to begin with

Rob
@Nobody Yes, and I'm assuming she's contributing. Plus SE's money

Rob
So

user310756
@Rob you think there wasn't defamation? I haven't read the news articles to be honest

user310756
@Rob I don't understand how build first then burn

Rob
@Nobody The only thing I've seen SE say was that she broke the CoC. That's not defamation, as it's not specific

user310756
6:00 AM
@JourneymanGeek for one momentm forget that it is me who has posted the question - pretend it's someone you highly respect

Rob
People can disagree that there was a violation, but that's a separate issue

user310756
@Rob yeh, I did wonder about that.

Rob
Build first = things were built. JG said no build just burn existing ones, rather than go the extra mile.

@Nobody I would tell them they are being silly and burning bridges

Rob
As I mentioned elsewhere; mods do this all the time with suspensions. "For rule violations". That's not defamation either, even if they disagree that they broke any rules

user310756
6:01 AM
my advice to M was to apply for reinstatement, as they offered. Then if they refuse - seek legal advice. But I'm not a lawyer

Rob
Brb

user310756
@JourneymanGeek not necessarily. If the company should be paying people

user310756
@Rob true. Defamation is hard, as you have to prove loss of income.

@Nobody None of the mods signed up for pay, or even any promise of future employment

user310756
@JourneymanGeek that's not the point, if what they are doing is actually illegal

6:03 AM
@Nobody uhm. So... no more mods.

Rob
Moderators aren't doing anything that an employee would otherwise need to do

Or SE moves its legal office to UK or Germany i guess

user310756
it's like the ToS - waiving the right to class action bla bla. None of that means anything. You can force people to sign contracts that are not legally binding

Rob
And as I commented, every user of the site is a volunteer.

user310756
@JourneymanGeek paid moderation

Rob
6:03 AM
Surely we can't expect every site to pay contributors? What about comments on a blog?

user310756
@JourneymanGeek that doesn't change anything

@Nobody they claim they can't afford more CMs.

user310756
moving forward perhaps

user310756
@JourneymanGeek that's their problem

@Nobody And ours
So here's a difficult thing
there's a certain amount of useful pressure

user310756
6:04 AM
@Rob this is different - it's a huge company - making money and actively trying to profit off the site

It needs to be directed

user310756
@JourneymanGeek the site is currently being destroyed. :\

And? How does it help build stuff back up again?

user310756
Anyway - I'm going to investigate this myself

user310756
@JourneymanGeek it makes the site fair and equitable in all ways

6:06 AM
@Nobody I'm not doing this for the money

Rob
@Nobody The size of the company doesn't matter, though. Also, if I put ads on my blog, do I then need to pay everyone who comments?

And this could mean no site.
Is this ok?

user310756
@Rob that's tangential to this - I cannot answer every use case

user310756
@JourneymanGeek currently - the site as it is, is not ok.

user310756
if the site is breaking the law, it should be addressed.

6:08 AM
@JourneymanGeek I'd certainly be disappointed if the entire network ceased to exist.

@Nobody sigh

user310756
@JourneymanGeek don't act like that sigh

user310756
It's a legitimate argument and sighing acts like "here we go again" and is dismissive

user310756
it's not an intelligent response

I appreciate the entusiasm, and when SE goes bankrupt from class action lawsuits from ex mods (some of who, are not nice people), I'm sure we shall all be happy when justice is done.
I can't think of any way this would do anything more than hurt the community

6:12 AM
@Nobody I mean... it'd put us out of business. There's 556 mods. That's... almost twice as many people as are currently on staff.

user310756
@JourneymanGeek "some of who, are not nice people" hm, not sure if that is necessary.

@Nobody It is true
I am literally thinking of folks who would be happy to do so.

Well, one of them is literally in jail for child porn or something so... not a nice person at all.

user310756
@Catija are you sure it would put you out of business? Have you seen the financials for the business

@Nobody That's basically 2x as many as total staff.

user310756
6:13 AM
@Catija yes, it was more it was an odd comment - like if 95% of mods are good people..

Um... you think we like having only 7 CMs?

@Nobody I'd rather they spend money on getting more CMs than paying mods.

user310756
@Catija I think the company is out to make money and it is minimising wherever possible and is top heavy in many places. I think the CMs are treated like the mods (except you're paid)

user310756
I honestly think the company is misguided - I put it on youtube before all this blew up

I'm explicitly not allowed to talk about financial stuff but ... if we had to pay mods, we'd just shut down everything except SO.

user310756
6:16 AM
They are burning through money is some unnecessary places and not putting enough investment into where it counts i.e. the Q&A

user310756
@Catija if they

user310756
oops enter

I don't want to be snarky but you literally just asked me
3 mins ago, by Nobody
@Catija are you sure it would put you out of business? Have you seen the financials for the business

So... I'm gonna shoot it back at you...

user310756
6:17 AM
@Catija shoot it back at me how?

A lot of mods can't and don't want to be employees, and we'd essentially be a remote content moderation sweatshop

user310756
we already are a remote content something

@Nobody I work here. I'm making educated guesses based on the information I do actually have... you are basing your guesses on what?

user310756
@Catija observations on what the CEO was asking in terms of getting another round of funding - watching the history of the site - the changes in employment - laying off employees - a flourish of new employment - "not having" $ to invest in improving the platform (feature requests) - then having money to make changes. IMHO they

user310756
oops enter

user310756
6:20 AM
they've employed too many superfluous people and not focused enough on what brings traffic - the Q&A site.

Traffic is an expense, not revenue.

@Nobody We don't actually know how stuff is spread out

user310756
they will end up having more lay offs. Probably have a sacrificial lamb to account for all this drama

user310756
@Catija I'm aware of that and watching them try to capitalise on it has been painful and embarrasing at times.

user310756
they are desperately trying to milk it. It's obvious to anyone with eye balls

6:21 AM
I wouldn't trust a message from a CEO to a business paper. Anything that isn't all sparkly in there means the actual state is so bad you can't even pretend it doesn't exist when talking about your financial future.

user310756
and in doing so have trodden on pretty much everyone who interfaces with the site publicly - CMs included.

user310756
@JohnDvorak I do not trust the CEO

user310756
I have a scathing lack of respect for SOInc the business

user310756
it's the CMs and the community I have cherished

... maybe I'm missing things but... wouldn't looking for more funding be an indicator that we ... aren't sustainable?

user310756
6:23 AM
@Catija oh yes indeed. It means the writing's on the wall. They have gotten so much money and are running through it.

?
That... doesn't make sense.

Either SE isn't sustainable, or they introduced unacceptable advertising because of ... greed?

user310756
meaning - what is the future for the place

I'm sure there's a fancy business word for focusing purely on your purse

user310756
@Catija it means - if they're going to destroy it - with mismanagement - maybe the people who helped get it there should be given something on the way out. I'm sure there'd be someone willing to buy out the site when the current owners go broke - the site will continue. The company maybe not

user310756
6:25 AM
@JohnDvorak the changes in the home page - the push on teams - employment - the teams and the new landing page of SO - looks like a standard ASP.NET layout.

And the chronic brain drain

user310756
I've never spoken up before like this - I've tried to be supportive - but the company itself is incompetent. It's typical of the thousands of businesses that gets money and it pours through their hands as they haphazardly attempt to make money and employe the wrong people - do not have the right structure and have a glut of employment, without focusing on developing the thing that gets them the funding in the first place.

user310756
@JohnDvorak it's been exhausting.

user310756
I'm tired of trying to stand behind this business. What for?

user310756
The CMs - yes I stand behind them - they are not the business

user310756
6:28 AM
Watching this dumpster fire - as people put it- and how badly it's been handled - I am shaking my head.

user310756
There's no true leadership being shown from the higher echelons of the business

Rob
We have tiny sites, like Community Building and new sites with few users/traffic - so if money was super tight new projects wouldn't be started, I doubt that the business is doomed to failure. If plans (proposals ,/ changes / ideas) put forth went through a private internal process similar to the public process for new site creation (at Area 51) they'd be better off.

do they not have an internal process to vet any change through several people?
I don't think they're that bad

user310756
The more important question to ask here is whether a moderator actually qualifies as a "volunteer" under any laws. I doubt it does, even though we tend to attach the word volunteer to what they do. If it did, way larger companies than us would have run into problems by now, e.g. Steam which has the same concept of "volunteer moderators" on their forums. — animuson ♦ 56 mins ago

user310756
6:33 AM
@Rob the small sites would need to be governed by a separate entity

user310756
@JohnDvorak too many people - it's become a bureaucratic nightmare

Rob
They are not at the moment, why change it?

user310756
if it's illegal, they shouldn't be allowed to get away it

user310756
in all seriousness - if they are breaching employment laws - they shouldn't be doing that. It's actually irrelevant whether people think it's ok or not

Rob
Now this is a dumpster fire:

user310756
6:37 AM
that's really good artwork

Rob

Pro-tip: snow has negative nutritional value in every respect, including hydration.

Rob
The child thinks the falling ashes are snow, and catches them on the tongue, meanwhile a mile away huge factories smokestacks pollute the neighborhood (for many decades) to provide employment for the townsfolk.

and that's excluding the effects of having your mouth wide open for extended periods in that kind of weather in the first place
Maybe the ash contains some fancy hallucinogens?

mag

user310756

@JohnDvorak how so with hydration?

You spend energy heating up the snow, and breathe out more water than you eat

I think that depends on how you melt the snow

user310756
that's so sad

user310756
on that note. I think I will go and do something .. that produces more happy... :(

It's.... interesting... to see that the outrage has taken a more legal turn lately.

mag
@user58 seems like that's the only recourse left
everything else hasn't produced any results
I don't think it's particularly fruitful, but people will use what they can

7:11 AM
Aside from the legal defamation thing, it looks like people are looking into, say, whether or not the entire volunteer moderator thing is legal.
And the licensing thing, people were talking about legalities of that.

mag
the reason for that is people feel powerless
the company doesn't look like it cares the faintest bit about the outrage
so what do people gravitate towards when they feel like they have no lever to effect change?
The 10k or so monica has raised so far is an indication that we're all out of other options to make ourselves heard

@user58 that's what happens when you manage to seriously piss off the community.

@user58 uhm

JAD
7:33 AM
@user58 It feels a bit like clutching at straws
looking for anything that might throw a spanner into the works, just out of spite

Rob
✔️

mag
When people feel like peaceful protest doesn't work anymore, they'll try other things

JAD
Which gets you into the burning bridges territory JG mentioned

mag
This is part of the cycle when people are pushed over a line they're unwilling to tread
bargaining, argument, peaceful protest, more serious protest and finally
burning the entire thing to the ground with any means you got just to make it clear you're unwilling to tread that line
some people operate this way
and for everyone who does, that line is somewhere different. It seems like this time enough people have been pushed over to cause a bit more of a stir

JAD
7:48 AM
I think what stops many people from walking away is the community. By trying to burn everything down, the community is actually one of the first to become collateral damage

mag
I'm not at that point yet or possibly ever
I have zero love for the company left but I love this place to bits, still
I'm not going to be part of its destruction

JAD
huh interesting

Uhm I have a bit of an opinion I don't want to voice cause I'm a mod here 🤣

JAD
last week, Gitlab announced that they're going to add telemetry to their enterprise line of on-prem packages
Now they have retracted that decision
> On October 23, we sent an email entitled “Important Updates to our Terms of Service and Telemetry Services” announcing upcoming changes. Based on considerable feedback from our customers, users, and the broader community, we reversed course the next day and removed those changes before they went into effect. Further, GitLab will commit to not implementing telemetry in our products that sends usage data to a third-party product analytics service. This clearly struck a nerve with our community and I apologize for this mistake.

@JAD that's a negative take on why I made my post. I don't like it. So if you're going to surmise, perhaps consider people do not have spiteful intentions. That's in your mind.

JAD
@Nobody Enlighten me. Why did you make that post? What is it supposed to accomplish?

user310756
if they are breaking the law - they shouldn't be. Or do you think it's ok that they do break the law if they're breaking the law?

mag
this isn't really about labor law is it

user310756
The question should be - why are people ok with the company possibly breaking the law

mag
8:26 AM
in over a decade this hasn't come up, why now?

user310756
@mag erm. I beg your pardon? It is

user310756
@mag because someone posted a self answered question on meta about it

user310756
don't blame me

user310756
I'm not suing the company. I haven't posted questions asking for organised action against the company. I've gone against all of this.

Okay Tavern, should I or should I not dip a cinnamon cookie in a cup of coffee? Quickly.

mag
the timing and the context of it just feels vindictive

user310756
If someone posts something stating and it's supported by a staff member - that they appear to be breaking labour laws, then it's a serious thing

@user58 yes

@Bart please support your conclusion with reasoning and explanation

JAD
Ok, and if following the letter of the law means that all other sites than SO can't exist anymore, that's fine too?

8:29 AM
@user58 did you ever see me approach any situation with logic or reasoning? Just dunk the damn thing.

mag
I love this place, I'm not in favor of any course of action that would completly destroy it
labor law or not

@Bart fair enough

JAD
@user58 Cinnamon makes everything better, so yes

user310756
@mag stop maligning my character. I have initiated no harsh action against this site during all this. In fact I asked they stop allowing these posts. When something SERIOUS - breaking labour laws is SERIOUS comes up. It's on me as a bad person with spiteful intent. It's not ok for people to be making money off people illegally. It's immoral. That's my stance. If you've noted anything I've stood up for, it's pretty consistent. I'm a left wing voter - in case it didn't already show

user310756
@JAD if they're breaking the law and some people are lining their pockets off the work of others illegally - that's not ok

8:31 AM
@JAD Cinnamon tea! :D

user310756
if the company goes broke and no one even knows if it would - the site would be bought by some other entitiy

it doesn't mean it would cease

why do you go from me questioning your motives directly to "you're maligning my character" that's nothing of the sort

it means this company would cease

It's ok for people to actually contribute money to sue the network - an action no one knows what consequences it will have. For people to form a group and actually leave their posts. Take over the site with posts intent on rubbishing the network. When I say - hey this post saying the network may be breaking the law is not ok - what should we do. I'm the one destroying the network?

user310756
@rene read the video description - just posted it youtube.com/watch?v=cxAlEYmwZ8c

JAD
Don't you need standing in the US to sue? Are any mods actually in favor of seeking litigation for this?

user310756
Now can anyone see that there's some hypocrisy in this?

user310756
8:35 AM
@JAD I have no idea. It's why I asked the question

user310756
I'm not even saying I want to sue the network - I think they need to abide by labour laws

JAD
So far I've seen one mod respond saying that it would do more harm than good

Ended up with a soggy cookie and no noticeable improvement in taste to either one. 2/10, would not recommend

user310756
It's insanity that people can write hundreds of posts criticising the network and one post that actually questions the legality of the network's practices - the person is demonised. It's not ok to keep singling out one person, because the majority doesn't agree with that person's viewpoint. Don't malign an individual because you don't agree with them. Arguing the actual post is one thing - arguing against the person's intentions or personality is not ok.

@user58 :( There are cookies that actually do work nicely when dunked in tea... Or get a stroopwafel and put it on top of a hot cup of coffee/tea, until the cookie gets soft and the caramel slightly melted :D

user310756
8:37 AM
ok I hope I've addressed the issues. I don't want people rubbishing me in here

@Tinkeringbell I don't think I've ever even seen a stroopwafel

@Nobody that cat looks remarkably similar to the cat we had when I still lived with my parents.

@Nobody in all honesty, I don't think they are breaking the law, but IANAL. And I really don't think that any such posts will have any long-term effects. I wouldn't worry too much about such discussions, not even in this climate.

@user58 Too many people on here are missing out... I'm thinking of starting some kind of Santa Stroopwafel Service this year :P

They seem to stick mostly to the Netherlands, it would appear

JAD
8:39 AM
@Tinkeringbell But what about speculaas? And kruidnoten. So many cookies to share

@JAD Oooh, kruidnoten! I should get my brother to make those with me if my parents are going out this weekend.
@user58 I've heard rumours they migrated to the USA too...

JAD
@user58 I remember a season of the Great British Bakeoff where they had to make stroopwafels
it was a disaster

Oh, do you have a season/episode number? That sounds like it'd be perfect to watch this week :D

JAD
oof, lemme see
2017-4 it seems to be

@JAD I don't think we are

8:43 AM
God, now I want stroopwafels

@JAD Thank you!
@Bart Same :)

I'll have to settle for another cinnamon cookie.

@Tinkeringbell some time ago I got notified that a supermarket here had them. Bought them ... god they were bad. I can buy real ones here online, but they're expensive. So I'll have to wait for Christmas I guess :D

@Bart What did they do to make such horrible stroopwafels? :P

Oh people murder things by making cheap bad versions all the time

8:49 AM
@Tinkeringbell The wafel part of it was just some hard-baked crispy cookie, and the stroop turned out to be some strange caramel nonsense.

you can't get a proper donut in this country anywhere

@Bart Oh, those aren't stroopwafels. They're karamelkoeken XD

@Tinkeringbell but sold as freaking stroopwafels. FOR SHAME

That must've been a trademark violation...

Btw, you want to know what's fun to do here in this chocolate loving nation? Give them Tony's Chocolonely chocolate. And when they ask what the heck that is, tell them it's the only slave-free chocolate producer around ... you get interesting discussions :D

8:56 AM
Not Milka? :P

Nope, most definitely not.

@Bart so Milka has slaves?

Purple cows ...

If a factory hires someone who usually earn 0 and gives them 5 dollars per month, dunno if it's called slavery.

Within their chocolate production somewhere along the line there will be slave labour, yes. "Fun" thing is, Tony's Chocolonely was sued years ago for defamation with the other party simply stating it was impossible to produce chocolate without slave labour.

Well... you can say the same about everything in modern society. Clothes, food... anything.
So neglecting single branch is pointless.
(for one who wants to make a real change)

Surely you're not arguing that making actual change in a single industry is pointless if not tackling the issue as a whole?

@Bart the documentary from Teun van der Keuken on that subject was/is epic.

@rene yup. Just brilliant.

@Bart if you can make the change yourself (e.g. you're CEO of such a factory) sure go ahead, but I mean that as a "simple" person not buying certain chocolate brands won't make any change.

I disagree with the latter. Sure, you need many people on board to make a real impact, but going "it doesn't matter because it's just me" for sure won't do any good.

9:09 AM
Well, I'll sum this up (for myself) with "we can't fix the world"... and time for a coffee...
!!/coffee

@Shadow brews a cup of Affogato for @Shadow

@Shadow we can fix the world. Just needs a lot of other we's

@rene true

10:06 AM
@rene @Bart this headline Am I the only one that sees it?

Nope, LOL!

That's one person that should get a raise :P

JAD
I'm amazed that nobody smelt it the moment the cake was served

Yeah, that's... suspicious ;)

Can I flag that as not inclusive to people who don't understand German? Translation please :P

JAD
10:10 AM
maybe expectations of funeral cake were sufficiently low that nobody noticed

mag
@SPArchaeologist-様 thats dutch

JAD
@SPArchaeologist-様 funeral home accidentally served spacecake

It's also not like you won't taste something on the first bite...

mag
source: german native speaker who can't read it either

@SPArchaeologist-様 There were edibles served at a funeral in a place called 'Wiethagen' (wiet = weed)

10:12 AM
@JAD maybe there were already weird smells ...

@JAD had to google that but.... yep. That is pretty bad.

JAD
@SPArchaeologist-様 oh sorry, thought that was a common term

@JAD They were in a deep sorrow that their senses didn't work.

@JAD It should be... but apparently it's not...

JAD
@Tinkeringbell such a lack of culture :P

10:13 AM
We can probably introduce it via this room, like we did stroopwafels ;)

@JAD I understood it by the cotent of the article.

mag
@Tinkeringbell stoopwafels with extra stroop

@mag I wonder what would happen if you combined the two ;)
Stroopwafels and spacecake , that is.

JAD
spacewaffles?

they have my vote!

JAD
10:15 AM
given that anything with weed in it is disgusting, probably disgusting

whatup.

? I had one once, wasn't too bad... wouldn't call it disgusting. Brussels sprouts are disgusting... and they only make you gassy.

JAD
A flatmate of mine once bought a space brownie. He couldn't get it down. Tried to make a smoothie out of it. Didn't help

mag
@Tinkeringbell sugar shock and type 2 diabetes

JAD
@Tinkeringbell I don't know anybody that partakes weed for the taste tbh
or the smell for that matter

10:16 AM
@JAD Oh, probably not... but I just wouldn't call it disgusting either...
There's worse things out there ;)

JAD
ok, but mixing weed with stroopwafels is a waste of perfectly good stroopwafels

We could mix it with the horrible ones Bart mentioned this morning ;)
@djsmiley2k-CoW Eh, not much...
There?

Everyone at work is Ill. The normally overflowing carpark is half empty
I'm the only one in the office. but fortunately it's quite quiet.

That actually sounds quite nice, if that means you won't be saddled with everyone's work as well

yeah
well, we work on tickets, so I just deal with what I can, when I can
also got project work 'on-going' but.... my brain is fried currently (maybe I'm ill, or getting ill) so kinda glad I can take it quiet easy.

Here we are sitting in the calm of the storm before the end of the year rush. Healthcare season starts in 2 weeks.
Last ~6-7 weeks of the year where it's possible to switch healthcare insurances for the next year

@Tinkeringbell hahaha

@djsmiley2k-CoW are you in some densely-packed open office dystopia?
Those are great at spreading disease.

yas
and I'm sure our aircon is doing bad things like dumping all the heat from the DC directly onto us.

10:48 AM
where can one find API documentation for a userscript for loading question tags from like ~10 questions at a time?

@user1306322 stackapps.com?

just documentation on the API
I think the user can write a script on their own
they wanted a link to the API info

oh cool thanks
