ArjanSince May 2011, images uploaded through SE sites are uploaded to stack.imgur.com. Just checked, and that was indeed the case. Fixed the spreadsheet.

7:11 PM
Let's start counting.

@bjb568 jackass.
2

@Shog9 Is . . . that a compliment?

Basically the post said and stills ays to some diegree:
"thank you for upvoting previous post, it take it that you liked the propeosal. If you would have hated it youd have downvoted it right"

@joojaa I think that's overly pessimistic. It's useful to know where folks stand, where their concerns are on stuff like this - even if they're not overly positive. Especially if they're not overly positive.

So the community says.... Oh we were supposed to downvote
thats how i read it

7:13 PM
Pretty much.

yeah, the commentary on voting was... Misguided

Well, I'm yet to vote.
I don't code here and I don't need to decide about the license.

I think we were all gratified that the initial post scored well, but that wasn't really the purpose of the follow-up

@Shog9 Then make it clear. Some folks are just -1ing for that very statement.

An awful lot of folks were uneasy about the attribution proposal the first time around, so Sam went & talked to the lawyer & thought about it a bit and discussed it internally and came to agree that it wasn't a good idea; this was supposed to be announcing that.

7:15 PM
Look the license is no matter to me. It does not apply. MIT or CC im shielded in my jurisdiction no difference even no license would have same effect. Id still have to attribute it, and I still would be in my rights to copy it.

@Shog9 O_O
That's not what I read.
Is there going to be a second "We screwed up"?

Nothing SE can do to change my local laws

@Ϻ.Λ.Ʀ. Iterative design, right? Propose something, get feedback, make changes in response to the feedback, get more feedback, rinse, repeat...
@Ϻ.Λ.Ʀ. yeah, so... I don't think you're alone
The problem with a month of internal discussion is that it's easy to forget what hasn't been actually said publicly
and assume that folks on meta are following along when they're just waiting for the other shoe to drop

OK appreciate the fact that this was a PR mistake but still. Best to close the post and begin anew.

Hoo boy. We're making history.

7:18 PM
@joojaa so, whining about votes aside, we're still getting some pretty good feedback here
look at the answers
Folks who read through the whole post are making some reasonable points

@Shog9 And you should get Sam a new account 'cause he won't be able to answer protected questions after some time.

Your doing the cardinal design flaw... you have planned it you have almost executed it and you discover a lee bit of a flaw in your design. Sounds like you just want to push it out due to exhaustion.

Danger lies on that road!

Or does that limit not exist for mods?

No mods have all rights

@joojaa ugh. So... That bit kinda got lost here too I guess.
We're in no particular hurry.

7:19 PM
@Shog9 The initial post didn't score well.
The community doesn't like it now, they didn't like it then, they will never like it. It's a bad idea.

@joojaa Argh. Dammit. Joke ruined. My life is over. Blasphemy of the day.

@bjb568 I was speaking literally
(I'm not sure what you're speaking)

Literally?

literally
as in, the post score was positive
aaanyway

@Shog9 See, that's the problem. Don't expect everyone coming all over the network to know or adhere to "-1 if you disagree".

7:21 PM
If your not in hurry, then why does it seem like you are?

@Ϻ.Λ.Ʀ. really don't care about votes here. They're a nice barometer, but you don't look at the barometer to decide if it's raining on your head.

The post itself had a bunch of downvotes, the only reason it was positive was because of group mentality and a bunch of people getting directed there that couldn't DV it.

@joojaa the current tentative deadline is March 1st. Previously Feb 1st. Can just as easily be June 1st or 1/1/2017
More important to get it right than to get it done fast

Then say so...

> We want to hear what you think. Barring any showstopper, these terms and a detailed FAQ will be rolled out March 1, 2016.
This says the opposite.
> When will the new terms go into effect?

> March 1, 2016

7:24 PM
exactly

This too ^^
It reads like "We are going to change thing! We made post before and it do good! We improve idea even more! We totally going to change thing! Any ideas?"

@bjb unfortunately our plans are amiss. Sam is actually gaining rep by that post!

Then obviously, "Why the hell are you changing thing? I don't want my thing changed. What's the problem this is trying to solve? There aren't enough details here. What do you mean, you'll write the FAQ on what's code later?"
In essence, it looks like no thot was put into the change at all.

To begin the discussion you should have started:

"We would like to discuss the possible change of licensing agreement"

- There is no hurry take your time. Obviously we would like some resolution before the heat death of the universe so we have put a deadline 3 months form now for a initial commitment.

OK waiwaiwait, why are we changing licences in the first place? Lemme go back to the roots . . .

It needs to identify a problem, propose a solution, explain the reasoning behind the solution, show how the solution will solve the problem, and show why this is the best solution to the problem.
It currently fails on all of these.

So @Shog you guys are essentially changing the license for code since CC-BY-SA is ambiguous about code?

Because some people cant copy paste CC code into their codebase but MIT is fine.
for fuck sake your actually supposed to write your own code.
2

buht… buht… waht about jQuery plugin?

engineering by subcontracting is allowed.
Thing is responsibility to understand and maintain your code is yours alone.

7:30 PM
@Ϻ.Λ.Ʀ. So... I think this explains the problem better than anything I could write:
35
A: What is up with the source code license on Stack Overflow?

Jeff Atwood I had to email him the solution to remove his fears of licensing Maybe he's afraid of the monsters under his or her bed, too? Is this one user representative of the majority? Or any sizable contingent of the audience? It's not a license mess, some people are a mess. The footer says: us...

@Shog9 If by reading meta stuff I've reached any conclusion, it's that nothing explains the problem better than stuff you write.

@Ϻ.Λ.Ʀ. Therefore, part of the problem of that post was that @Shog9 did not write it?
2

@Shog9 Yup, that's what I thot, and that's what's on DevDoodle.

I think the central problem is and not just here but everywhere: Nearly no one understands copyright, me, you certainly not, a copyright lawyer knows what he does not know. So he knows he doesn't understand it.

@Ϻ.Λ.Ʀ. just read that answer. It's 6 years old now, and quite frankly I agree with it.

7:33 PM
@SimonKlaver Siempre es una problema…

It's also singularly unhelpful to folks for whom licensing actually matters

@SimonKlaver Scratch part of.

You tell a lawyer "dude, you afraid of monsters under your bed?" he sez "yes, and so should you be"

buht monstars are skary!

Most folks shouldn't have to worry about licensing when reading or writing on SO
But...
That's idealistic

7:35 PM
I also agree with it. Code snippets do not get copyright because they dont have high enough status to warrant being called works.

There are monsters out there
One of 'em sells a big expensive database and a programming language originally designed for set-top boxes
And folks are scared

I'd say that when you post code on SO, you better make sure it just addresses your problem, and not shows your 'ingenuity' (which you might want to keep secret).

They're scared that they could get sued for using some trivial code snippet they copied rather than re-write from scratch because there's only so many ways to write an if statement
They're scared that they could get sued for using code they wrote themselves if it wasn't clear what license applies or which context it was written in
Blame the Gov't, blame the courts...

!!/blame

@Ϻ.Λ.Ʀ. It's Ϻ.Λ.Ʀ.'s fault.

7:37 PM
blame yourselves for eating cupcakes instead of writing your legislator
doesn't matter, blame doesn't fix anything

@SmokeDetector Oh shut.

But that's the problem we have to solve:
Common sense doesn't matter anymore
Not when it comes to licensing
We need a clear statement of intent, some guidelines that working programmers and authors can understand and use

@Shog9 You successfully made my head hurt. Not that it's hard tho'.

So just because some people are insecure, we who arent need to change... sheesh

Because "talk to your lawyer" is effectively "runawaaaay" for an awful lot of people
Good people. Honest people
Because... Dishonest people don't care.
Dishonest people copy code and lie about where they got it

7:39 PM
I actually have pretty good experience with lawyers

@Shog9 There are good people on SE?

Dishonest people strip the comments and obfuscate the source

expensive yes as such but not as expensive as not getting things done right

@joojaa if you're working in a shop where you don't control the budget and the legal department defaults to saying "no" to any request that doesn't come from a VP, then it doesn't matter. You can't hire a lawyer to freelance for you.
So we need a way of squaring this, a way to communicate what The Right Thing To Do is to the folks who Want To Do The Right Thing
Because that's the best we can hope for
A license that keeps honest people honest

Shooooooog

7:41 PM
Not one that forces honest people to be dishonest

Alright everyone, please read the conversation above than asking @Shog to repeat what he said. Start with chat.meta.stackexchange.com/transcript/message/4454880#4454880

"Code is property of poster. Anybody can use it. Poster is not responsible. Give credit."
There I fixed the license.

That's roughly what MIT is supposed to be
except all lawyerly and stuff

in SO Close Vote Reviewers on Stack Overflow Chat, 3 hours ago, by rene
Never thought pair-programming would mean I would pair-up with my lawyer while I write code with bits-and-pieces found on SO.

7:44 PM
We are on -40. Is there a limit?

@Shog9 in my experience only those people who want to do something wrong expect others t do so...

@SimonKlaver When Sam downcapped.

So i always negotiate by suggesting a better deal to my opponent than they proposed.
Those that try to screw you will then go bonkers because wheres the catch and suddenly they negotiate a FANTASTIC deal to you

@joojaa so, usually when folks contact us about this it's because their employer's legal dept. started sending out emails telling folks they can't use SO
It's rarely if ever a lone dev, small shop or freelancer

So i worked for a company that essentially said no copypasting form the internet for any reason. And im all fine with that. If they WANT to be innefective its their right. Just dont come complaining to me after ive pointed that one out.
They SHOULD be made to rot in the pit. There has to be some cost for bad legal advice.

7:47 PM
At one past job, my team had to fight to get permission to include an LGPL library with our internal distro
we got the attribution right, the docs telling folks where to get the code, all the right stuff
still had to argue about it
It cost us time

Legal profession isnt very big on lunches for free
I mean most of them think that leads to lawlessness
Theres no way around that.

that's a nice way of saying they take their cut at every opportunity

Essentially a lawyer gets nothing by saying ok go ahead
Its like somebody coming for you to to consult you on how to get this super app they envisioned done with cash in hand... I doubt many coders would say, not worth coding.
Many would THINK that.

@rene dang lol

Maybe we should ask the UN to get rid of lawyers? After they managed world peace...

7:53 PM
Sanction SO, obviously.

No... that wouldnt work out very well.
We just need to start deprecating some of the law in the books. Too much of it around.
